Conditions

The terms that cover orders, film processing, shipping, pickup and using Graination's services and spaces. Written to be read, not buried.

1 · Overview

These terms apply to the transactions you make with Graination — placing an order, submitting film, buying products, booking a service or joining a membership.

When you place an order, the version of these terms presented to you at that point forms part of the agreement for that transaction. At checkout, the Place Order action is how you accept them: a short notice sits with that button linking these terms and the related Returns & Refunds, Shipping & Pickup and Turnaround policies. If you'd rather not accept them, don't complete the order.

Browsing the website on its own isn't an agreement to the transaction-specific rules below — those attach when you buy something, book something or hand us your film.

2 · Business information

These terms are between you and:

3 · Orders, payment & pricing

  • Prices are listed in Canadian dollars unless stated otherwise.
  • Taxes, shipping, discounts and fees are shown at checkout where applicable. Before the final purchase action you'll see your items, service selections, totals and delivery method, with a chance to go back and correct them.
  • An order is confirmed when we accept it and issue an order confirmation. Payment timing and available payment methods are shown at checkout.
  • Promotional, member, wholesale or discounted pricing may carry separate terms and may not be combined unless clearly stated.
  • You choose the service options, film type, shipping or pickup method and contact information — please check them before you place the order.

If we find an error. If a material pricing, inventory, listing or technical error, or an unavailable service, comes to light before we start the affected work, we'll either contact you to approve a corrected order, or cancel and refund the affected part of the order. We won't raise the price of an order you've already placed without your agreement.

If your order information is wrong or incomplete. We may pause the order and contact you for clarification, correct it where that's straightforward, or cancel it where the work can't reasonably be done. If a correction would add a material charge, we'll get your agreement before charging it, unless the law clearly allows otherwise.

4 · Film developing, scanning & printing

We handle customer materials carefully and process every roll with attention. Developing, scanning and printing involve physical materials, chemistry and equipment, so some factors can't be completely controlled.

Things that arrive with the film. Results can be shaped by conditions that exist before we ever see a roll — camera or shutter problems, exposure and loading errors, improper rewinding, light leaks, expired or physically damaged film, heat, water or humidity, unknown prior storage and handling, airport X-ray or CT exposure, contamination including remjet, film submitted under the wrong process, or incorrect instructions. These aren't service failures on our part, though we'll always tell you what we see.

Normal technical and aesthetic variation. Scanning and printing involve interpretation as well as measurement. Colour, contrast, density, crop, grain rendering, sharpening, dust visibility and tone can vary between scanners, monitors, printers, papers and viewing light. Reasonable variation of this kind isn't automatically a service failure.

Higher-risk work. Push and pull processing, ECN-2, expired film, unusual formats, damaged rolls and experimental or non-standard materials carry more risk than routine work. We'll flag it where we can.

We may decline to process material that appears unsafe, contaminated, severely damaged, mislabelled, improperly packaged or unsuitable for the requested process.

Nothing here reduces our obligation to provide our services to the standard required by applicable law.

5 · Your materials & if something goes wrong

Exposed film, negatives, slides, photographs, original artwork and other materials you submit may be unique or irreplaceable. We treat them that way.

If you think we caused a problem with developing, scanning, printing or handling, contact us as soon as reasonably possible so we can investigate properly — the sooner we look, the more we can usually establish. Please include your order number, what you're seeing, and any supporting photographs or files.

Where we determine that an issue was caused by us, we'll review the circumstances in good faith and work with you toward a fair resolution. Depending on what happened, that might mean correcting the work, re-scanning, reprinting, re-performing the service where possible, a refund or partial refund, replacement film or product, store credit, or another reasonable solution we agree on.

To the extent permitted by law, we aren't responsible for indirect, consequential, speculative, sentimental or lost-opportunity losses that aren't legally recoverable — the commercial or personal value attached to an image can reach far beyond the service itself, and we're a lab, not an insurer of that value. Nothing in this section removes rights or remedies that can't legally be waived.

6 · Turnaround times

Next-day by midnight is our standard turnaround under normal operating conditions.

  • Next-day means ready by midnight the next day — not guaranteed before our 6 PM close, and not a strict 24-hour clock.
  • Turnaround begins when your order is checked in at the main Graination lab — not when it's mailed, handed to a carrier, left at an independent drop-off location, or marked delivered by a carrier.
  • Where we know in advance that a broader delay will affect new orders, we'll make reasonable efforts to communicate the changed turnaround before purchase. Unexpected disruptions can occasionally arise after an order is placed; where that happens we'll let you know about material delays as soon as reasonably practicable.
  • Rush or priority turnaround applies to the work we perform — not shipping, transfer from a drop-off location, or other third-party time.

7 · Pickup & holding period

  • Please collect negatives, prints, retail products and other physical orders within 30 calendar days of your order being ready for pickup.
  • We may send pickup reminders as a courtesy. A reminder isn't a precondition to the holding period, so please keep an eye on your order status and give us contact details that reach you.
  • Materials still uncollected after the holding period may be disposed of to the extent permitted by law and may no longer be recoverable. We don't donate or publicly redistribute customer image-bearing materials.
  • If you need more time, contact us before the holding period ends — extensions are fine, we just need to confirm them.

8 · Digital files & download links

  • Download links are normally available for 2 weeks unless stated otherwise.
  • Please download promptly and keep your own backup. We're a lab, not a permanent archive, backup service or cloud-storage provider.
  • Expired links may stop working, and re-upload or recovery isn't always possible.

Link expiry is a separate matter from how long we retain information internally — see the Privacy Policy for retention.

9 · Shipping & mail-in

Sending materials to us. You choose the carrier and are responsible for packaging your film or materials properly. Tracking is worth using where available, and insurance is worth considering for valuable or irreplaceable materials. Shipping carries risks we don't control — carrier delay, customs, heat or cold, water, X-ray and CT exposure, theft and misdelivery among them. The lab clock starts once we physically receive and check in your order; a carrier marking a parcel "delivered" isn't the same as lab check-in.

Sending things to you. We use third-party carriers, and carrier delay, loss or damage can be outside our direct control. We'll reasonably assist with available carrier claims, and the carrier's rules and timelines apply. None of this removes obligations that can't legally be excluded.

Additional charges. Additional shipping or correction charges may apply where the information provided is incorrect or a parcel has to be resent. Material additional charges will be disclosed before being charged where required.

10 · Third-party drop-off locations

  • Independent drop-off locations are separate businesses that accept Graination orders as a convenience. They're intake and transfer points — all developing, scanning and printing happens at our Toronto lab.
  • Turnaround begins at check-in at the main lab, so transfer time from a drop-off location sits outside the turnaround window.
  • Individual business hours and transfer schedules vary by location.
  • Please include complete order information and contact details with every drop-off order — it's the single biggest cause of avoidable delay.

11 · Returns, refunds & service corrections

Photographic and instant film — including 35mm, 120, 220, sheet, 110 and other photographic film, and Instax Mini, Wide and Square — is final sale for change-of-mind returns and exchanges, opened or unopened. Film is affected by storage, temperature, handling and environmental conditions after it leaves us, so we can't reliably take it back into saleable inventory. This final-sale rule covers change of mind. It doesn't limit rights or remedies that may apply where a product is defective, not as described, or where applicable law otherwise provides a remedy.

Other retail products may be returned for change of mind within 14 calendar days — from purchase for in-store, from pickup for pickup orders, from delivery for shipped orders. Items should be unused, unopened, in original condition and packaging with included components, and supported by a receipt or a purchase we can verify from your order history. Approved refunds normally return to the original payment method. Original outbound shipping and return shipping for a voluntary change-of-mind return generally aren't refundable unless we agree otherwise or the law requires it.

If we've made a service error, contact us as soon as reasonably possible after you spot it, with your order number, a description and supporting images or files where useful. We'll investigate and work with you toward a fair resolution as described in section 5.

12 · Chargebacks & payment disputes

  • If there's a problem with an order, please contact us first — most things are quicker to fix directly.
  • If a chargeback or payment dispute is filed for a completed service or delivered product, we may provide order records, communication history, service records and pickup or download records to the payment provider.
  • Fraudulent, abusive or bad-faith disputes may result in refusal of future service, to the extent permitted by law. This doesn't affect your right to raise a genuine dispute with your payment provider.

13 · Your content, copyright & refusal of service

  • You keep the copyright and ownership you already have in what you submit. Nothing here transfers ownership of your images to us.
  • By submitting images, negatives, files or other materials, you give us the limited permission needed to handle, reproduce, scan, process, print, store temporarily and transmit them as reasonably necessary to provide the service you asked for — and nothing beyond that.
  • We don't use customer work for advertising, promotion or public display just because it passed through the lab. If we'd like to feature something, we'll ask you first.
  • You confirm you own or have permission to submit the material you give us, and that you're responsible for copyright, permissions, model and property releases and lawful use.
  • We may decline orders involving unlawful or clearly infringing material, unsafe or contaminated materials, or where there's abusive, threatening, harassing or fraudulent behaviour, dangerous equipment use, or repeated serious policy violations. Refusals are tied to legitimate legal, safety and business concerns.

14 · Darkroom, self-scan, space access, memberships, workshops & events

  • Please follow posted rules, staff instructions, safety and chemical-handling procedures, booking times and equipment instructions. We may refuse or stop unsafe use.
  • Certain customer-access spaces or equipment may be subject to additional safety rules, acknowledgements or waivers before access is provided.
  • You may be responsible for damage caused by misuse, negligence or failure to follow instructions.
  • Bookings, memberships, workshops, cancellations, no-shows and rescheduling may be governed by additional terms shown at purchase. Workshops and other scheduled sessions may carry their own booking and cancellation terms — those are the terms shown to you when you book.
  • We may suspend or cancel access for safety, misuse, harassment, non-payment, repeated no-shows or rule violations.
  • Future offers and services can change. For an existing paid or continuing arrangement, material changes are made in line with the applicable agreement, the terms disclosed at purchase, and any notice, consent or choices required by law — we don't retroactively change the price or core terms of an arrangement you've already bought by editing the website.
  • Memberships and space access are personal, and can't be shared, transferred or resold unless we clearly allow it.

15 · Product information & website accuracy

  • We work to keep product and service descriptions accurate, but errors happen. Product packaging, label design, batch appearance or colour may vary from photographs unless a specific characteristic is stated as part of the product description.
  • Inventory changes, and we may correct errors, update prices, remove listings or change services going forward. Where an error affects an order you've already placed, section 3 applies — we contact you or cancel and refund, rather than silently changing the deal.

16 · Accounts, security & communications

  • Please keep your account, order, billing, shipping and contact information accurate, and your login secure.
  • Transactional messages — order confirmations, payment issues, pickup notices, download links, shipping and booking updates, account and security messages, membership administration and order support — are sent as needed to administer your order, booking, account or membership.
  • Marketing messages — newsletters, promotions, sales, product campaigns and event announcements — are sent only where permitted by applicable law, and subject to consent and unsubscribe rights. Unsubscribing from marketing doesn't stop the transactional messages needed to run an existing order, account, booking or membership.
  • Marketing consent is separate from placing an order and is never required to buy.
  • Please contact us if you think an order is delayed, missing, incorrect or not received.

17 · Privacy

We collect the information needed to process orders, provide services, communicate with you, run accounts, prevent fraud, meet legal obligations and operate the business. We do not sell your personal information. Full detail — including what we collect, how long we keep it and how to make a privacy request — lives in our Privacy Policy.

18 · Events outside reasonable control

Some events genuinely sit outside a lab's control: major power or utility failure, fire, flood, severe weather, natural disaster, building emergency, government restriction, major carrier disruption, and sudden equipment failure despite reasonable maintenance. Where one of these delays or prevents performance, we're not responsible for the resulting delay — but we'll communicate and work through it with you.

This doesn't cover ordinary planning, routine staffing or preventable maintenance failures, and it doesn't apply where we've failed to exercise the standard of care required by law.

19 · Changes to these terms

The version of these terms presented in connection with a transaction applies to that transaction. We may update these terms for future transactions. A later version doesn't automatically replace the terms of a completed transaction unless you agree or applicable law permits the change. For continuing arrangements such as memberships, the rules in section 14 apply.

20 · Governing law

These terms are governed by the laws of Ontario and applicable Canadian federal law. Consumer protection rights that apply regardless of a governing-law clause are preserved.
